I have a misrepresentation finding under s. 40 IRPA. What now?

A finding of misrepresentation carries a five-year inadmissibility, but the analysis does not end there. We review the materiality of the alleged omission, the reasonableness of any explanation, and any procedural fairness issues in how the finding was reached. Where appropriate, we prepare submissions for reconsideration, judicial review counsel referral, or a future TRP/PR strategy.

How do I know which permanent residency stream applies to me?

What should I bring or prepare for the consultation?

Please gather: prior refusal letters or GCMS notes, copies of all applications submitted, medical exam results (if applicable), passport/travel documents, proof of relationships (marriage certificate, birth certificates, etc.), work or education credentials, and any IRCC correspondence. The more complete your documentation, the more thorough our assessment will be. We will send you a detailed prep checklist after booking.

Can you represent me if I hire you? Or do I need a lawyer?

As an RCIC - IRB, we have full representation authority before IRCC, the Immigration and Refugee Board, and CBSA. We do not require a lawyer to be involved — though if your matter involves criminal law implications or judicial review, we can coordinate with counsel. Our scope of practice covers the entire immigration and procedural fairness spectrum.

What happens after I retain you?

Upon retainer: you receive a written engagement letter outlining scope, fees, and timeline. We conduct a thorough file assessment (GCMS notes if applicable), research current case law and IRCC instructions, develop a submission strategy, and keep you informed at every stage. You will receive written documentation at consultation, file assessment, before submission, and upon each IRCC response. Direct communication is always with the RCIC of record.

How much does representation cost?

Consultation fees are outlined at booking. Representation retainers vary by matter complexity: Express Entry and straightforward PR applications differ significantly from refusal appeals or procedural fairness work. We provide a fixed-fee estimate in writing before engagement. Payment plans are available for larger matters. We do not work on contingency — fees are earned regardless of outcome.

What if I have an urgent deadline or hearing date?

Procedural fairness letters, hearing dates, and removal orders require immediate action. Notify us immediately if you have an active deadline. Depending on complexity and available preparation time, we assess whether the timeline is achievable. Some urgent matters require a compressed consultation and accelerated submission timeline; we will confirm capacity and fees before proceeding.

Do you offer document translation or notarization?

We do not provide translation services directly. However, we coordinate with accredited translators and will manage the quality and submission of translated documents on your behalf. Notarization can be arranged through our office. We ensure all supporting documents meet IRCC standards before filing.

How do you communicate with me during the process?

Communication is via secure email or phone. We provide a written status summary within two business days of each significant milestone (assessment completion, pre-submission review, post-submission response). You receive written notification before any IRCC submission is filed. Routine updates are provided by email; urgent matters receive same-day contact.

What if IRCC asks for additional information after filing?

IRCC requests for additional documentation (RFI) are common. We monitor your file, receive the request notification, assess the deadline and evidentiary requirements, and prepare and submit a comprehensive response on your behalf. This is included in ongoing representation — you do not pay additional fees for RFI responses.
